Accessing the Services.

In addition, if the Service is an App, unless otherwise indicated, we grant you a non-exclusive, non-transferable, revocable, limited license to use the App on an authorized device for your personal, non-commercial use. The App may not be copied, resold, or sublicensed. These Terms apply to all versions, including but not limited to free versions and updates to the App.

The App may include measures to control access to the App (including age controls), prevent unauthorized copies, or otherwise attempt to prevent anyone from exceeding the limited rights and licenses granted in these Terms. You may not take any steps to circumvent or defeat such security features. If you disable or otherwise tamper with technological protection measures, your license to use the App or other Services will be automatically revoked.

Third-Party Products, Services, and Links

We may offer third-party products through the Services. You assume all risks and responsibilities associated with the use of any such third-party products. In addition, your rights and obligations with respect to such products or services will be subject to the separate terms of use and privacy policies of the applicable third-party providers.

The Services may contain hyperlinks to third-party websites that we do not control. We are not responsible for the availability of such external third-party websites or resources and are not responsible or liable for any content, advertising, products or other materials on or available from such third-party websites or resources.

User Content:

If you post, publish, transmit or upload User Content on the Service, you agree that it is: accurate; non-confidential; does not violate the law; does not violate contractual restrictions or the rights of another party and that you have the right to use the User Content of any other party whose personal or other information or intellectual property is contained in the User Content; and is free of viruses, adware, spyware, worms or other malicious code.

Assignment

We may assign our rights or obligations under these Terms, Feature Terms or Community Rules to any person or entity at any time, with or without your consent. You may not assign your rights or obligations under these Terms, Feature Terms or Community Rules to anyone without our written consent, and any attempt to do so without our consent will be void.

Disclaimer

To the maximum extent permitted by applicable law, you expressly agree that the Service is provided to you "as is". Therefore, such service is at your own risk and satisfactory quality, performance, accuracy and effort are with you.

Accordingly, PANCHESTONE does not make, and hereby disclaims, any and all express, implied or statutory warranties, including but not limited to the implied warranties of condition, uninterrupted use, accuracy of data (including but not limited to location data), merchantability, satisfactory quality, fitness for a particular purpose, non-infringement of third party rights, and warranties arising out of course of dealing, usage or trade practice, if any. PANCHESTONE DOES NOT: (A) WARRANT THAT INTERFERENCE WITH YOUR ENJOYMENT OF THE SERVICE WILL BE PREVENTED; (B) THE SERVICE WILL MEET YOUR REQUIREMENTS; (C) THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR (D) THE SERVICE WILL INTERACT OR BE COMPATIBLE WITH ANY OTHER SERVICES OR THAT ANY ERRORS IN THE SERVICE WILL BE CORRECTED. NO ORAL OR WRITTEN ADVICE GIVEN BY PANCHESTONE

OR ITS EMPLOYEES OR OTHER REPRESENTATIVES SHALL CREATE A WARRANTY.

If any jurisdiction does not allow the exclusion of any warranty in the manner set out above, then such terms shall not apply to you. In such case, the above warranty exclusions shall apply to the maximum extent permitted subject to the applicable laws of such jurisdiction.
